NOTICE OF CONSTABLE’S SALE

Under the authority and by virtue of an ORDER OF SALE dated and issued on the 8th of January, 2024 pursuant to the judgment of the Honorable 425th District Court of Williamson County, State of Texas by the clerk of said court as shown in the following schedule of cases,  Cause Number 23-0849-C425: Heritage Park Homeowners Association, Inc., Plaintiff(s), recovered a judgment on the 16th  day of August, 2023 against Scott Dreyer and Alexa Dreyer, Defendant(s), in the amount of:

    $ 2,693.34, plus $ 5090.50 attorney fees, plus costs of court, associated fees and interest.

To me directed and delivered as Constable in Williamson County, I have seized and levied upon the following property on  February 14th, 2024, at 11:00AM and will on the 1st Tuesday of  April 2024, that being April 2nd, 2024 at the Williamson Co. Courthouse Annex,  405 MLK in Georgetown, Texas between the hours of Ten O’clock A.M. and Four O’clock P.M. proceed to sell for cash to the highest bidder all of the right, title, and interest of the said Defendant Scott Dreyer and Alexa Dreyer, in the real property, as described below in order to satisfy said judgment, interest, penalties, and costs.

A Cashier’s Check or Certified Check upon a national or state bank or Bid Bond payable without recourse to GABH, LLC, in an amount not less than five percent (5%) of the total maximum bid price (Bidder’s Check or Bid Bond), must accompany the bid proposals as a guarantee that, if awarded the contract, the bidder will within ten (10) days of the award of the contract, enter into a contract and furnish an acceptable performance and payment bond in the amount of one hundred percent (100%) of the contract price. The Bidder’s Check or Bid Bond will be forfeited and become the property of the Owner should the bidder fail to enter into a contract and furnish bonds acceptable to the Owner within ten (10) days after award of the contract. The notice of award of contract shall be given by the Owner within sixty (60) days after the bid opening. The Bidder’s Check or Bid Bond must be enclosed in the same envelope as the bid. Bids without a Bidder’s Check or Bid Bond will not be considered. All bid securities will be returned to the respective bidders within seventy-two (72) hours after bids are opened, except the three most qualified bidders, which the Owner elects to hold until the successful bidder has executed the contract. Thereafter, all remaining securities, including security of the successful bidder after entering into a contract, will be returned within forty-five (45) days of the notice of award. The successful bidder must furnish performance bond and payment bond in the amount of one hundred percent (100%) of the contract price from an approved surety company holding a permit from the State of Texas to act as surety (and acceptable according to the latest list of companies holding certificates of authority from the Secretary or the Treasury of the United States) and having Best Key Rating Guide of A or better.

No proposals shall be withdrawn for a period of sixty (60) days after the opening of the bids.

A maintenance bond to the City of Pflugerville will be required in the amount of thirty-five percent (35%) of the contract and is to remain in force for a period of two (2) years from the date of final acceptance from the City. (Items within City of Pflugerville ETJ).
