The Berry Creek Interceptor includes construction of 24,084 linear feet of 60”, 54”, 48”, 36”, 18”, 12”, 8” sanitary sewer with associated appurtenances over the Edwards Aquifer Recharge Zone. NOTICE OF ADOPTION OF AN ORDER ESTABLISHING SERVICE RATES, CHARGES, AND TAP FEES AND ADOPTING RULES AND POLICIES WITH RESPECT TO THE DISTRICT’S WATER, WASTEWATER, AND DRAINAGE SYSTEMS
The Board of Directors of Sonterra Municipal Utility District (the “District”) has adopted an Order Establishing Service Rates, Charges, and Tap Fees and Adopting Rules and Policies with Respect to the District’s Water, Wastewater, and Drainage Systems (“Rate Order”), which amends and restates the District’s prior order of the same name by amending provisions relating to the District’s builder deposits, including modifying the amounts of such fees and deposits from a flat sum to an amount per Living Unit Equivalent for each connection, and adopting other various rules and policies with respect to the District’s water, wastewater, and drainage systems.
Violations of the rules or failure to pay the fees contained in the Rate Order will result in the offending party being subject to the payment of a penalty, not to exceed $5,000 per violation. Each day during which an offense continues will constitute a separate violation. In addition, the violating party will be liable to the District for any other penalty provided by the laws of this state, and any costs incurred by the District in connection with any repairs or corrections necessitated by the violation. If the District prevails in any suit to enforce the provisions of the Rate Order, the District may additionally recover its reasonable attorneys’ fees, expert witness fees, and other costs incurred by the District before the court. Pursuant to Sections 49.004 and 54.206 of the Texas Water Code, the Rate Order may be enforced by complaints filed in the appropriate court of jurisdiction in Williamson County, Texas and will be recognized by the court as if they were penal ordinances of a city.
