Place and Time of Award: The District will consider the award of the sale of the Bonds on Thursday, November 2, 2023 at 12:00 PM, C.D.T. at the designated meeting place outside the boundaries of the District, at the offices of Gray Engineering, Inc. 8834 North Capital of Texas Highway, Suite 1400, Austin, Texas 78759. Action will be taken immediately by the Board of Directors of the District to accept or reject the best bid. Each bidder must deliver a Bank Cashier’s Check in the amount of $320,000 payable to the order of Williamson County Municipal Utility District No. 34 as a good faith deposit to Public Finance Group LLC, 17128 Casanova Ave, Pflugerville, Texas 78660, by 10:00 AM C.D.T. on the date of the sale.

Electronic Bidding Procedures: Any prospective bidder that intends to submit an electronic bid must submit its electronic bid through the facilities of PARITY between 9:00 AM and 10:00 AM, C.D.T., on Thursday, November 2, 2023, as described in the “Official Notice of Sale” described below.

Subscription to the i-Deal LLC’s BIDCOMP Competitive Bidding System is required in order to submit an electronic bid through PARITY. An electronic bid made through the facilities of PARITY shall be deemed a sealed irrevocable offer to purchase the Bonds on the terms provided in this Official Notice of Sale, and shall be binding upon the bidder as if made by a signed, sealed bid delivered to the District. Neither Public Finance Group LLC nor the District shall be responsible for any malfunction or mistake made by, or as a result of the use of the facilities of PARITY, the use of such facilities being the sole risk of the prospective bidder.

Bids by Electronic Mail (only if PARITY is unavailable): Any prospective bidder that intends to submit a bid by Electronic Mail, in the event PARITY is not functioning or unavailable, must submit its bid between 9:00 A.M., C.D.T. and 10:00 A.M., C.D.T., on the date of the bid opening. Electronic Mail bids to the attention of Cheryl Allen will be accepted at callen@publicfinancegrp.com. All bids must be submitted on the “Official Bid Form” without alteration or interlineations. Copies of the Official Bid Form accompany the Preliminary Official Statement.

The District and Public Finance Group LLC are not responsible if such electronic mail is malfunctioning which prevents a bid or bids from being submitted on a timely basis. The District and Public Finance Group LLC will not be responsible for submitting any bids received after the above deadlines. The District and Public Finance Group LLC assume no responsibility or liability with respect to any irregularities associated with the submission of bids if the electronic mail bid option is exercised.

The bidder whose bid is the lowest bid in accordance with the “Official Notice of Sale” will be notified immediately by Public Finance Group LLC and must submit a signed Official Bid Form in connection with the sale by 10:30 A.M., C.D.T. on Thursday, November 2, 2023 to Cheryl Allen, Public Finance Group LLC at callen@publicfinancegrp.com. Additionally, pursuant to Texas Government Code Section 2252.908, the District may not award the Bonds to the winning bidder unless the bidder either (i) submits a Certificate of Interested Parties Form 1295 (the “TEC Form 1295”), as prescribed by the Texas Ethics Commission, to the District, before the Board of Directors of the District formally votes to award the Bonds to the winning bidder, or (ii) certifies in the Official Bid Form that it is exempt from filing the TEC Form 1295 by virtue of being a publicly traded business entity or wholly owned subsidiary of a publicly traded business entity, in accordance with the “Official Notice of Sale.”

The District reserves the right to reject any or all bids for the Bonds and to waive any and all irregularities except time of filing. This notice does not constitute an offer to sell the Bonds but is merely notice of sale of the Bonds as required by law. The offer to sell the Bonds will be made only by means of the “Official Notice of Sale,” the “Preliminary Official Statement” and the “Official Bid Form.”

Notice of Intent to Construct and Operate an Authorized Municipal Solid Waste Disposal Facility

TCEQ Permit No. MSW-2398 — Williamson Transfer Station

The Texas Commission on Environmental Quality (TCEQ) issued Municipal Solid Waste (MSW) Permit No. 2398 to Lealco, Inc. on October 22, 2020, authorizing the construction and operation of Williamson Transfer Station, a Type V MSW management facility (Facility), to be located within the extraterritorial jurisdiction of the City of Hutto and approximately 0.8 miles east of the intersection of CR 130 and Chandler Road in Williamson County, Texas. On November 12, 2020, the TCEQ’s decision to issue Permit No. MSW-2398 became final and non-appealable. Lealco, Inc. is providing notice that it will begin construction and operation of the facility at a future time. The estimated date when the Facility is expected to begin construction is January 2024.

The activities authorized by TCEQ Permit No. MSW-2398 include the storing and processing (transferring) of waste. The facility is authorized to accept and transfer municipal solid waste which includes wastes resulting from or incidental to municipal, community, commercial, institutional, and recreational activities such as garbage, rubbish, ashes, street cleanings, and automobile parts; construction or demolition waste; special waste which includes deceased animals, drugs, contaminated goods, empty containers, which have been used for pesticides, herbicides, fungicides, or rodenticides, and non-RACM; Class 2 nonhazardous industrial solid waste; and Class 3 nonhazardous industrial solid waste. The facility is not permitted to accept regulated hazardous waste, Class 1 industrial solid waste, radioactive waste, PCB waste, infectious medical waste, or bulk liquid waste.

A bid, which in the opinion of Jonah Water Special Utility District’s staff, deviates significantly from the required specifications, and which has not been clarified through a written addendum prior to the bid submittal deadline, shall be considered an exception to the contract documents and grounds for the bid to be rejected.

Contract time is of the essence and substantial completion shall be no later than 180 calendar days after execution of the contract.
