Bidders should carefully examine the plans, specifications, and other documents, visit the site of proposed work, and fully inform themselves as to all conditions and matters, which can in any way affect the work or the cost thereof. Should a bidder find discrepancies in, or omissions from the plans, specifications, or other documents, or should be in doubt as to their meaning, the Engineer shall be notified, and clarification obtained prior to submitting any bid.

A Cashier’s Check or Certified Check upon a national or state bank or Bid Bond payable without recourse to GABH, LLC, in an amount not less than five percent (5%) of the total maximum bid price (Bidder’s Check or Bid Bond), must accompany the bid proposals as a guarantee that, if awarded the contract, the bidder will within ten (10) days of the award of the contract, enter into a contract and furnish an acceptable performance and payment bond in the amount of one hundred percent (100%) of the contract price. The Bidder’s Check or Bid Bond will be forfeited and become the property of the Owner should the bidder fail to enter into a contract and furnish bonds acceptable to the Owner within ten (10) days after award of the contract. The notice of award of contract shall be given by the Owner within sixty (60) days after the bid opening. The Bidder’s Check or Bid Bond must be enclosed in the same envelope as the bid. Bids without a Bidder’s Check or Bid Bond will not be considered. All bid securities will be returned to the respective bidders within seventy-two (72) hours after bids are opened, except the three most qualified bidders, which the Owner elects to hold until the successful bidder has executed the contract. Thereafter, all remaining securities, including security of the successful bidder after entering into a contract, will be returned within forty-five (45) days of the notice of award. The successful bidder must furnish performance bond and payment bond in the amount of one hundred percent (100%) of the contract price from an approved surety company holding a permit from the State of Texas to act as surety (and acceptable according to the latest list of companies holding certificates of authority from the Secretary or the Treasury of the United States) and having Best Key Rating Guide of A or better.

No proposals shall be withdrawn for a period of sixty (60) days after the opening of the bids.

The Owner reserves the right to reject any and/or all bids and to waive all technicalities or formalities in the bidding process. The Owner also reserves the right to determine which bid is most advantageous, and to award the contract on this basis.

A maintenance bond to the City of Pflugerville will be required in the amount of thirty-five percent (35%) of the contract and is to remain in force for a period of two (2) years from the date of final acceptance from the City. (Items within City of Pflugerville ETJ).

A maintenance bond to Manville WSC will be required in the amount of one hundred percent (100%) of the contract and is to remain in force for a period of one (1) year from the date of final acceptance from the City. (Items within Manville WSC).

A maintenance bond to Lakeside Municipal Utility District No. 5 will be required in the amount of ten percent (10%) of the contract and is to remain in force for a period of one (1) year from the date of final acceptance from the District.

WILLIAMSON COUNTY MUNICIPAL UTILITY DISTRICT NO. 15

NOTICE of ADOPTION OF AMENDED RULES REGARDING STORMWATER POLLUTION PREVENTION REQUIREMENTS

The Board of Directors of Williamson County Municipal Utility District No. 15 (the “District”) has adopted the following Amended and Restated Rules Regarding Stormwater Pollution Prevention Requirements. Among other requirements, the Rules require compliance with the District’s stormwater management plan, applicable provisions of TPDES General Permit No. TXR040000, any stormwater pollution prevention plan for the site, and any maintenance plan for stormwater control measures for the site. Violations of the Rules may result in a penalty in the amount of $5,000 per offense or in an amount per offense that does not exceed the jurisdiction of a justice court, as provided by Section 27.031, Texas Government Code. Each day of violation constitutes a separate offense. The offending party will also be liable for any costs incurred by the District as a result of the violation.

Each Bid must be accompanied by a Bid Bond or certified or cashier’s check, acceptable to the Owner, in an amount not less than five percent (5%) of the total amount Bid, as a guarantee that the successful bidder will enter into the Contract and execute the Bonds on the forms provided and provide the required insurance certificates within seven (7) days after the date Contract Documents are received by the Contractor.
