Esto es para dar aviso de que la Ciudad de Florence ha realizado una evaluación según lo requiere la Orden Ejecutiva 11988, de acuerdo con las regulaciones de HUD en 24 CFR 55.20 Subparte C Procedimientos para tomar determinaciones sobre la gestión de llanuras aluviales. Aproximadamente 0.23 acres de actividades del proyecto estarán en la Zona A de la llanura aluvial de 100 años en Beck Street.
La Ciudad de Florencia ha considerado las siguientes alternativas y medidas de mitigación a tomar para minimizar los impactos adversos y restaurar y preservar los valores naturales y beneficiosos: Diferentes Actividades del Proyecto:
Una alternativa considerada fue hacer un proyecto completamente diferente, sin embargo, el proyecto propuesto incluye reemplazar las líneas de agua existentes de diámetro inferior al estándar 2: ubicadas dentro de partes de la llanura aluvial de 100 años de FEMA. Este aumento en la capacidad de flujo también ayudará con la presión y se pueden instalar hidrantes contra incendios en la nueva línea de agua de 6" para proporcionar una mayor capacidad para satisfacer la demanda máxima fluye en caso de que sea necesario. Por lo tanto, se determinó que los límites del proyecto que cruzan parcialmente la llanura aluvial de FEMA deben permanecer en el proyecto. CERTIFICACIÓN AMBIENTAL

In addition, the violating party will be liable to the District for any other penalty provided by the laws of this state, and any costs incurred by the District in connection with any repairs or corrections necessitated by the violation. If the District prevails in any suit to enforce the provisions of the Rate Order, the District may additionally recover its reasonable attorneys’ fees, expert witness fees, and other costs incurred by the District before the court. Williamson County Municipal Utility District No. 19C (the “District”) has adopted Rules Regarding Erosion Control and Protection of District Facilities and Systems (the “Rules”) to protect the District’s utility and drainage facilities and systems (collectively, “District Systems”), and the water quality within the District. The Rules regulate activities during development and construction, and require the submittal of related plans; the installation, maintenance, and inspection of erosion control devices and construction dumpsters; and the removal of construction debris. The Rules prohibit any foreign materials or debris (including motor oil, grass, leaves, or tree clippings, trash, construction debris or silt) from being placed, thrown, disposed of, deposited, discharged, or allowed to migrate into the District Systems. Breach of the Rules may subject the violator to a penalty in an amount $500 per offense together with the payment of all costs incurred by the District in connection with the violation. REQUEST FOR RELEASE OF FUNDS
On or about 06/09/23, the City of Florence will submit a request to the Texas Department of Agriculture (TDA) Office of Rural Affairs for the release of 2022 Community Development Funds under Section 104(f) of Title 1 of the Housing and Community Development Act of 1974 as amended, to undertake the project known as Water System Improvements #CDV21-0049 for the purpose of addressing the undersized waterlines and to improve the water distribution system. Water Improvements: Replace approximately one thousand eight hundred fifteen linear feet (1,190 l.f) of water line, gate valves, fire hydrant assemblies, service reconnections, trench repair and all associated appurtenances, to include administration services and engineering fees. Locations: Beck Street and Lackey Street. Northeast Area of the City, City of Florence, Williamson County, Texas. Approximately 0.23-acres of project activities will be in Zone A of the 100-Year Floodplain on Beck Street. The rest of the site is in Zone X. FINDING OF NO SIGNIFICANT IMPACT
The City of Florence has determined that the project will have no significant impact on the human environment; therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. FINAL NOTICE AND PUBLIC EXPLANATION OF PROPOSED ACTIVITY
IN A 100-YEAR FLOODPLAIN
This is to give notice that the City of Florence has conducted an evaluation as required by Executive Order 11988, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management. Approximately 0.23-acres of project activities will be in Zone A of the 100-Year Floodplain on Beck Street.
The City of Florence has considered the following alternatives and mitigation measures to be taken to minimize adverse impacts and to restore and preserve natural and beneficial values: Different Project Activities:
An alternative considered was to do an entire different project, however the proposed project includes replacing existing 2: diameter substandard water lines located within portions of the FEMA 100-Year floodplain. The concerns of constructing improvements within the floodplain is possible adverse impacts to the floodplain area and increasing impervious cover, etc. The proposed project will include temporary rock berms and silt fence to capture runoff during construction activities. Also, the contractor will not be allowed to store materials in the floodplain. After the new 6" water line is constructed, the contractor shall restore the area, level the grades and provide vegetation restoration where required. There will be no increase to impervious cover as a results of this project. The new 6" water line will be capable of flowing up to 9x the volume of water that the existing 2" water line flows. This increase in flow capability will also help with pressure and fire hydrants can be installed on the new 6" water line to provide greater capability to meet peak demand flows in the event it is needed. Therefore, it was determined that the project limits that partially cross FEMA floodplain should remain in the project. No Action: Taking no action would incur no costs for the proposed water system improvements and would cause no construction-related environmental impact but would be unable to address the deteriorating water lines and would halt the proposed improvement of allowing reliable water lines that would be recognized as appropriate for the destruction by TCEQ, along with allowing for peak water demand capability in the area. No alternative was chosen since the project proposes to replace existing 2” water line that is in need of replacement. The chosen area will target more low-to-moderate income residents.
The City of Florence has reevaluated the alternatives to building in the floodplain and has determined that it has no practicable alternatives. Environmental files that document compliance with steps 3 through 6 of Executive Order 11988 are available electronically or by U.S. mail. There are three primary purposes for this notice. First, people who may be affected by activities in floodplains, and those who have an interest in the protection of the natural environment, should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplains can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains, it must inform those who may be put at greater or continued risk.

ENVIRONMENTAL CERTIFICATION
The City of Florence certifies to the Texas Department of Agriculture (TDA) that Mary Condon, in her capacity as Mayor, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. TDA’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Florence to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
TDA will accept objections to its release of funds and the City of Florence certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Florence; (b) the City of Florence has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by TDA; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
