A Cashier’s Check or Certified Check upon a national or state bank or Bid Bond payable to WBW Single Development Group, LLC - Series 103 in an amount not less than five percent (5%) of the total bid (Bidder’s Check or Bid Bond), must accompany the bid proposals as a guarantee that, if awarded the contract, the bidder will within ten (10) days of the award of the contract, enter into a contract and furnish an acceptable performance and payment bond in the amount of one hundred percent (100%) of the contract price. The Bidder’s Check or Bid Bond will be forfeited and become the property of the Owner should the bidder fail to enter into a contract and furnish bonds acceptable to the Owner within ten (10) days after award of the contract. The notice of award of a contract shall be given by the Owner within sixty (60) days after the bid opening. The Bidder’s Check or Bid Bond must be enclosed in the same envelope as the bid. Bids without a Bidder’s Check or Bid Bond will not be considered. All bid securities will be returned to the respective bidders within seventy-two (72) hours after bids are opened, except the three most qualified bidders, which the Owner elects to hold until the successful bidder has executed the contract. Thereafter, all remaining securities, including security of the successful bidder after entering into a contract, will be returned within forty-five (45) days of the notice of award. The successful bidder must furnish performance bond and payment bond in the amount of one hundred (100%) percent of the contract price from an approved surety company holding a permit from the State of Texas to act as a surety (and acceptable according to the latest list of companies holding certificates of authority from the Secretary or the Treasury of the United States) and having Best Key Rating Guide of A or better.

No proposals shall be withdrawn for sixty (60) days after the opening of the bids.

The Owner reserves the right to reject any and/or all bids and to waive all formalities in the bidding process. The Owner also reserves the right to determine which bid is most advantageous and would result in the best and most economical completion of the Project, and to award the contract on this basis.

Contractors must be plan holders/reviewers of record and must attend the mandatory pre-bid meeting to be eligible to submit a bid. A mandatory pre-bid conference will be held at 2:00 PM ON THE DATE OF NOVEMBER 16, 2023 at the office of Yalgo Engineering, LLC.

KINDSTEDT, Applicant in the above numbered and entitled estate, filed on the 29th day of September, 2023 an APPLICATION FOR DEPENDENT ADMINISTRATION AND ISSUANCE OF LETTERS OF DEPENDENT ADMINISTRATION AND DETERMINATION OF HEIRSHIP AND APPOINTMENT OF THIRD-PARTY ADMINISTRATOR of the said estate and requests that the said Court determine who are the heirs and only heirs of the said RALPH KILBURN PITCHER, DECEASED, and their respective shares and interest in such estate.
