A Cashier’s Check, Certified Check, or Bid Bond payable to Lennar Homes of Texas Land & Construction, Ltd. in an amount not less than five percent (5%) of the total bid must accompany the bid proposals as a guarantee that, if awarded the contract, the bidder will within ten (10) days of the award of the contract, enter into a contract and furnish an acceptable Performance and Payment Bond in the amount of one hundred percent (100%) of the contract price. The Bidder’s Check will be forfeited and become the property of the Owner should the bidder fail to enter into a contract and furnish bonds acceptable to the Owner within ten (10) days after award of the contract. No proposals shall be withdrawn for a period of sixty (60) days after the opening of the bids. The Owner reserves the right to reject any and/or all bids and to waive all formalities in the bidding process. The Owner also reserves the right to determine which bid is lowest and the best, and to award the contract on this basis. It should be noted that time is of the essence on this project.
