Miscellaneous

 

OFFICIAL NOTICE

The following is a substantive statement of certain rules adopted by Williamson-Liberty Hill Municipal Utility District prohibiting the unauthorized disposal of trash, refuse and debris on District property and to establish penalties for violation of such rules (the “Rules”).  The Board of Directors of the District adopted the Rules at its July 8, 2025 meeting pursuant to the authority set forth at Section 54.205 of the Texas Water Code, which authorizes a district to regulate privileges on any land or easement owned or controlled by the district.

The Rules generally prohibit the disposal of any trash, debris or refuse on any lands or property owned or controlled by the District.  This prohibition specifically applies to the disposal or deposit of solid waste, refuse, trash, landscaping trimmings, brush or any other materials on District property without prior authorization of the District’s Board of Directors.  The Rules provide that a person that violates the Rules shall be subject to a civil penalty of $100.00 dollars per violation per day the violation continues.  For any subsequent violation within twelve (12) months, the person shall be subject to a civil penalty of $200.00 dollars per violation per day the violation continues.  Any person who violates the Rules three times within a 12 month period shall be subject to a civil penalty of $500 dollars per violation per day the violation continues.  The Rules also authorize the District to pursue injunctive relief restraining any violation of the Rules.

  NOTICE OF ADOPTION OF ORDER ESTABLISHING RATES AND CHARGES AND ADOPTING RULES  AND POLICIES REGARDING THE DISTRICT’S SYSTEMS

   The Board of Directors of Williamson County Municipal Utility District No. 39 (the “District”)  has adopted an Order Establishing Rates and Charges and Adopting Rules and Policies Regarding  the District’s Utility Systems (“Rate Order”) which establishes rules and regulations to: (i) secure  and maintain safe, sanitary and adequate plumbing facilities as part of its sewer system; (ii)  preserve the sanitary condition of all water controlled by the District; (iii) prevent waste or the  unauthorized use of water; and (iv) regulate privileges on any land or easement controlled by the  District.

Violations of the rules contained in the Rate Order will result in the violator being subject to  a penalty in an amount per violation that does not exceed the jurisdiction of justice court, as  provided by Section 27.031 of the Texas Government Code. The offending party will also be liable  for any costs incurred by the District in connection with any repairs or corrections necessitated  by the violation. Specific penalties include a penalty not to exceed $5,000, plus any attorney’s fees  and courts costs, for violating rules related to fire hydrants or unauthorized taking of water, meter  tampering, bypass, or diversion, prohibited discharges of waste, or unauthorized dumping, with  each day of a violation constituting a separate violation.
