The contract will include furnishing all labor; material, tools and equipment and performing all work for the COPPER LANE PARK PLAYSCAPE IMPROVEMENTS (the “Project”).
BIDS will be received, opened, and publicly read aloud at 2:00 p.m., at the administrative office of SMUD located at 113 Limestone Terrace, Jarrell, TX 76537 on the same date. NOTICE OF ADOPTION OF ORDER ADOPTING RULES REGARDING THE DISTRICT'S DRAINAGE SYSTEM AND PROPERTY
The Board of Directors of Berry Creek Municipal Utility District (the “District”) adopted an Order Adopting Rules Regarding the District’s Drainage System and Property dated effective July 24, 2026 (the “Order”) in order to protect the District’s drainage system and property and water quality within the District. Among other requirements, the Order requires the installation, maintenance, and inspection of erosion control devices during construction and requires silt fence to be installed on the downstream side of all lots during construction activities on lots. A violation of the Order will result in the offending party being subject to the payment of a penalty in an amount determined by the Board that does not exceed the jurisdiction of a justice court, as provided by Section 27.031, Texas Government Code. Each day of violation constitutes a separate offense. In addition, the offending party will be liable for any costs incurred by the District, including, without limitation, legal fees, incurred in connection with enforcing the Order and any repairs or corrections necessitated by any violation, and will also be subject to any other penalties provided by state law. Pursuant to Sections 49.004 and 54.206, Texas Water Code, the rules contained in the Order may be enforced by complaints filed in the appropriate court of jurisdiction in the county or counties in which the District’s principal office or meeting place are located, and will be recognized by the courts as if they were penal ordinances of a city.
