OFFICIAL NOTICE

The following is a substantive statement of certain amended rules adopted by Stonewall Ranch Municipal Utility District relating to erosion control for protection of the District’s drainage, detention, retention, stormwater and water quality collection and treatment facilities (the “Erosion Control Rules”).  The Board of Directors of the District adopted the Erosion Control Rules on February 2, 2026 in accordance with the authority set forth at Section 54.205 of the Texas Water Code.

The Erosion Control Rules generally prohibit the disposal of unauthorized materials into the District’s drainage systems; prohibit unauthorized connections to the District’s drainage systems; require pre-construction notice by builders; require the submission of applications by builders for erosion control and environmental protection; require the installation and maintenance of erosion controls by builders; require the placement of dumpsters or other containers for disposal of wastes during construction activities; require wash-out sites by builders; and require the installation and maintenance of silt fencing.

The Erosion Control Rules provide that a person that violates the Rules shall be subject to civil penalties and reimbursement of the Districts costs.  The Erosion Control Rules provide for a warning for the first violation, a civil penalty of $100 per day for the second offense, a civil penalty of $250 per day for the third offense, a civil penalty of $500 per day for the fourth offense, and a maximum penalty of $1,000 per day for the fifth and subsequent offenses (with the specific amount to be determined by the Board of Directors for such offenses).  For purposes of administering the penalty schedule, the number of violations shall be determined over a rolling 12-month period.  Further, the number of violations shall be determined on a cumulative basis for each builder of property for all properties under construction within the District, and not on an individual lot basis.

AN ORDINANCE OF THE CITY OF WEIR, TEXAS, ESTABLISHING THE FEE SCHEDULE FOR THE PAYMENT OF ALL FEES, COSTS AND EXPENSES FOR THE DEVELOPMENT OF PROPERTY IN THE CITY; FEES, COSTS, AND EXPENSES SHALL BE PAID TO THE CITY ACCORDING TO THE SCHEDULE ADOPTED UNDER THIS ORDINANCE FOR ALL DEVELOPMENT FEES WHICH SHALL INCLUDE SUBDIVISION DEVELOPMENT FEES, PERMIT FEES, BUILDING FEES, INSPECTION FEES AND THE FEES SET FORTH IN THIS ORDINANCE; PROVIDING FOR REIMBURSEMENT TO THE CITY FOR ANY THIRD PARTY SERVICE COST WHICH THE CITY IS REQUIRED TO OBTAIN WHEN THE CITY DETERMINES THE THIRD PARTY SERVICE IS REASONABLE OR NECESSARY TO PROVIDE ANY SERVICE SET FORTH IN THIS ORDINANCE OR REGARDING DEVELOPMENT WITHIN THE CITY; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALING CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500) FOR EACH OFFENSE, EXCEPT WHERE A DIFFERENT PENALTY HAS BEEN ESTABLISHED BY STATE LAW FOR SUCH OFFENSE, OR FOR ANY VIOLATION OF ANY PROVISION WHICH GOVERNS PUBLIC HEALTH OR SANITATION WHICH SHALL BE PUNISHED BY PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2000); AND PROVIDING FOR PUBLICATION.
