The following is a substantive statement of certain rules adopted by Stonewall Ranch Municipal Utility District prohibiting certain actions on lands owned by the District to protect public safety and to ensure the proper functioning of the District’s drainage, detention, retention, stormwater and water quality collection and treatment facilities (the Pond Rules). The Board of Directors of the District adopted the Pond Rules in accordance with the authority set forth at Section 54.205 of the Texas Water Code.
The Pond Rules generally prohibit the following within the District’s pond and drainage facility lands: (i) glass containers; (ii) firearms; (iii) vandalism; (iv) cutting of trees; (v) motorized vehicles; (vi) camping and fires; (vii) fireworks; (viii) disorderly conduct and public intoxication; (ix) harassment of wildlife or damage to flora and fauna; (x) loose dogs; (xi) littering; (xii) boats; and (xiii) dumping of trash, refuse or other unauthorized materials. The Pond Rules provide that a person that violates the Rules shall be subject to a civil penalty of up to $5,000 per violation and payment of all costs and damages. The Pond Rules also authorize the District to pursue injunctive relief restraining any violation of the Pond Rules.
