Each proposal must be accompanied by a cashier’s check or acceptable proposal bond payable to the Travis County ESD #14 in an amount not less than five percent (5%) of the total proposed contract sum, plus alternates as submitted.

The successful proposer will be required to furnish payment bonds and performance bonds in amounts equal to one hundred percent (100%) of the contract sum, in accordance with Chapter 2253 of the Texas Government Code, within five (5) days of the contract award.

The successful proposer will also be required to pay $1,000 per day in liquidated damages for each day the new fire station does not reach substantial completion as agreed on in the Contract Documents.

Selection of the successful proposer will be based on the selection criteria set forth in the instructions to proposers. In case of ambiguity, duplication, or obscurity in the proposals, the Travis County ESD #14 reserves the right to construe the meaning thereof. The Travis County ESD #14 further reserves the right to reject any and/or all proposals and waive any informalities and irregularities in any and/or all proposals received. Contractors and subcontractors shall pay to laborers, workmen and mechanics the prevailing wage rates as determined by Travis County.

A Cashier’s Check, Certified Check, or Bid Bond payable to Continental Homes of Texas, L.P., on behalf of Leander Municipal Utility District No. 1, in an amount not less that 5% of the total bid must accompany each Bid as a guarantee that, if awarded the contract, the bidder will within 10 days of the award of the contract, enter into a contract and furnish an acceptable Performance and Payment Bond in the amount of 100% of the Contract price. The Bidder’s surety will be forfeited and become the property of the Owner should the bidder fail to enter into a contract and furnish bonds acceptable to the Owner within 10 days after awarding the contract.

Proposals shall not be withdrawn for a period of 90 days after the opening of the bids. The Owner reserves the right to reject any or all Bids and to waive all defects and irregularities in bidding or the bidding process, except the time of submitting the Bid. The Successful Bidder, if any, will be the responsible Bidder which the Owner’s judgment will be most advantageous to the District and result in the best and most economical completion of the Project.

A Maintenance Bond will be required in the amount of 10% of the contract price and is to remain in force for a period of one year from the date of the letter of final acceptance from Leander Municipal Utility District No. 1.

Prevailing Wage Rates, in accordance with Government Code 2258, are applicable to this project.
