NOTICE OF ORDER ADOPTING WATER CONSERVATION AND DROUGHT CONTINGENCY PLAN

TO: THE RESIDENTS AND TAXPAYERS OF SONTERRA MUNICIPAL UTILITY DISTRICT AND TO ALL OTHER INTERESTED PERSONS

NOTICE IS HEREBY GIVEN that the Board of Directors of Sonterra Municipal Utility District (the “District”) has approved an Order Adopting Water Conservation and Drought Contingency Plan (the “Order”). The Order establishes rules for water conservation and a drought contingency plan (“DCP”) for water use in the District. The Order prohibits a person from knowingly or intentionally using or allowing the use of District water for any purpose contrary to any provision of the Order, using water in an amount in excess of that permitted by the drought response stage in effect, or allowing water waste. Violations of the rules established by the Order may be subject to the payment of a fine in an amount per violation that does not exceed the jurisdiction of a justice court. Each day of violation will constitute a separate offense. The violator will be liable to the District for any costs incurred by the District in connection with any violation. Compliance with the Order may additionally be sought through injunctive relief in a Williamson County District Court. Violations occurring during Stage 1 or Stage 2 of the DCP will result in a warning notice for the first violation, a $200 fine for the second violation, and a $500 fine for the third violation. Violations occurring during Stage 3 or Stage 4 of the DCP will result in a warning notice for the first violation, a $2,000 fine for the second violation, a $10,000 fine for the third violation, and the discontinuation of water service for the fourth violation. Service discontinued under such circumstances may be restored only upon payment of all fines established in the Order, the reconnection charge established by the District, and any other costs incurred by the District in discontinuing or reinitiating service.
