Final Notice and Public Explanation of a Proposed Activity in a [100-Year/500-year Floodplain or Wetland]

To: All interested Agencies including all Federal, State, and Local Groups and Individuals

This is to give notice that Williamson County under Part 58 has conducted an evaluation as required by Executive Order 11988 and/or 11990, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Wetlands Protection. The activity is funded under the Community Development Block Grant under B-18/21-UC-48-0502. The proposed project is located in Granger TX, Williamson County. This project includes replacement of existing lines with 1,450 feet of 8-inch PVC wastewater line and associated manholes. Project will follow Willis Creek from the Fox Street lift station north to North Mustang Street in Granger, TX. The project will utilize Best Management Practices, using silt fencing to prevent erosion and ensuring of restoring the disrupted soil to its natural contours.

Williamson County has considered the following alternatives and mitigation measures to be taken to minimize adverse impacts and to restore and preserve natural and beneficial values: 1) Locate the project within the floodplain. Replace existing lines with 1,450 feet of 8-inch PVC wastewater line and associated manholes. 2) Locate the project outside of the floodplain. If the city were installing new lines, it could be constructed outside the floodplain. With replacement, the lines will not be relocated. 3) No action or alternative actions that serve the same purpose. A no action alternative was considered and rejected because of the improvements to the water lines are imperative to the continued service of the system.

Williamson County has reevaluated the alternatives to building in the floodplain and has determined that it has no practicable alternative. Environmental files that document compliance with steps 3 through 6 of Executive Order 11988 and/or 11990, are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments.

There are three primary purposes for this notice. First, people who may be affected by activities in floodplains and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplains can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains, it must inform those who may be put at greater or continued risk.

REQUEST FOR RELEASE OF FUNDS

On or after June 16,2023, Williamson County will submit a request to the HUD Office of Community Planning and Development San Antonio, TX for the release of Community Development Block Grant funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake the following project:

Project Title: Granger Colorado Street Wastewater Line Replacement

Purpose/Description: This project includes replacement of existing lines with 1,450 feet of 8-inch PVC wastewater line and associated manholes. Project will follow Willis Creek from the Fox Street lift station north to North Mustang Street in Granger, TX. The project will utilize Best Management Practices, using silt fencing to prevent erosion and ensuring of restoring the disrupted soil to its natural contours.

Location: Granger TX

Project Issues and Mitigation Measures/Conditions/Permits:

• Appropriate signage and traffic controls will be taken to ensure safety and accessibility at commercial and social service facilities.

• Construction waste should be properly disposed of in accordance with all state and federal laws.

• Noise abatement and controls will incorporate best management practices and be consistent with 24 CFR 51B. Best management practices and appropriate precautions should be taken to prevent increased noise levels other than normal operations and/or consistent with the City Ordinance.

• During construction, precautions should be taken through best management practices to minimize short term air quality impacts such as dust and other particulates.

• Best management practices to dispose of construction debris in accordance with state and federal requirements for solid waste management.

• Incorporate best management practices that avoid negatively impacting traffic, especially access to emergency services and social services.

• Best management practices should be used to prevent construction runoff from the job site by using silt fencing, berming and reseeding of disturbed area vegetation and returning the area to preconstruction conditions.

• The contractor should take appropriate actions to verify the locations and elevations of all other existing utilities within the project construction areas and locate lines within a distance consistent with state and federal requirements prior to beginning construction.

• Erosion controls to mitigate potential runoff during construction and re-vegetation to return ground to pre-construction condition.

• Precautions should be taken to prevent impact to federally or state listed threatened, endangered, or special status species or their critical habitats using best management practices of closely monitoring the sites during construction. If construction workers identify or encounter threatened or endangered species during construction, they should cease construction immediately and contact Texas Parks and Wildlife for further assistance.

• If buried archeological deposits are discovered during the development phases of the project, work should be stopped in the immediate area of such finds and the Williamson County Community Development Block Grant office should be contacted for further instruction.

• All easements and environmental permits must be obtained and regulatory requirements met.

Estimated Project Cost: $ 399,450

FINDING OF NO SIGNIFICANT IMPACT

Williamson County has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Williamson County CDBG Office, 710 Main Street, Ste 101, Georgetown, TX 78626 and may be examined or copied weekdays 8A.M to 5P.M.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to Williamson County CDBG Office, 710 Main Street, Ste 101, Georgetown, TX 78626. All comments received by June 15, 2023 will be considered by Williamson County prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION

Williamson County certifies to HUD that Bill Gravell in his capacity as County Judge consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Granger, TX to use HUD program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of funds and Williamson County’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of Williamson County; (b) Williamson County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be emailed to U.S. Dept. of Housing and Urban Development Office of Community Planning and Development at CPD_COVID-19OEE-SAT@hud.gov.
